These General Terms and Conditions (GTC) govern all deliveries of products as well as services (adult courses) provided by Herzschlag Kiefer GmbH (hereinafter referred to as “we” or “us”) to purchasers (hereinafter referred to as “you” or “the customer”).
These GTC apply to both:
Business Customers: Natural or legal persons entering into a business relationship with us in the exercise of their commercial or independent professional activity.
Consumers: Natural persons purchasing products or booking services from us outside any commercial or independent professional activity.
For services (courses): A binding contract between the customer and Herzschlag Kiefer GmbH is concluded upon registration for a course.
For products: By placing an order, the customer submits a binding offer to purchase. The contract is concluded when we expressly confirm the order or dispatch the goods.
Information provided in advertising materials, catalogs, and technical documents is non-binding unless confirmed in writing.
Product availability is subject to stock. If a product is no longer available, we reserve the right to propose an equivalent replacement or withdraw from the contract.
The prices for services (courses) and products are displayed on our website and are stated in CHF (Swiss Francs).
Shipping and packaging costs as well as any applicable taxes (e.g., VAT, customs duties) will be charged separately.
Payment may be made by bank transfer, Twint, or credit card.
For services (courses): Payment must be made no later than 14 days before the start of the course.
For products:
Advance payment or purchase on invoice (payable within 30 days) is possible.
In the event of late payment, default interest of 8% shall be charged.
The delivered goods remain the property of Herzschlag Kiefer GmbH until full payment has been received.
Cancellations are free of charge up to 14 days before the course date.
For cancellations made between 14 and 7 days before the course date, a processing fee of 50% of the course fee will be charged.
For cancellations made less than 7 days before the course date or in the event of non-attendance, the full course fee will be charged.
Unused products in their original packaging may be returned within 30 days of receipt.
Custom-made products are excluded from return.
Returns are made at the customer’s own cost and risk.
After inspection of the returned goods, a refund or credit note will be issued within 14 days.
If the goods are damaged or not in their original condition, we reserve the right to deduct an appropriate amount for loss in value.
Participants in certain courses will receive a certificate upon successful completion.
If a certificate is issued for a course, this will be stated in the course description.
A certificate can only be issued if the participant has attended at least 80% of the course.
If a certificate is subject to specific requirements (e.g., BLS-AED-SRC course), the participant must pass all required theoretical and practical assessments.
The cost of the certificate is included in the course fee unless otherwise stated.
If a replacement certificate is required (e.g., due to loss), a processing fee may be charged.
Partial deliveries remain reserved if this makes delivery more efficient.
Benefit and risk pass to the customer upon handover to the transport service provider.
Shipping costs are charged separately.
Depending on the shipping option selected, additional costs for customs, insurance, or express delivery may apply.
For business customers, the warranty period is 12 months.
For consumers, the statutory warranty period applies.
The customer is obliged to inspect each delivery immediately for damage, incorrect delivery, or shortages and to notify us within 3 working days.
We shall only be liable in cases of gross negligence or intentional misconduct.
Any liability for indirect damages, consequential damages, or loss of profit is excluded to the extent permitted by law.
The customer acknowledges that certain products may be subject to export restrictions. It is the customer’s responsibility to comply with all relevant regulations.
Customer data will be treated confidentially and will not be passed on to third parties unless this is necessary for processing the order or required by law.
We reserve the right to amend these GTC at any time. The current version of the GTC is available on our website.
Should individual provisions of these GTC be invalid, the validity of the remaining provisions shall remain unaffected.
Swiss law shall apply, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).
The place of jurisdiction is Rothrist, Switzerland.
